* § 1640-h. Residential parking system in the village of Cold Spring\nin the county of Putnam. 1. Notwithstanding the provisions of any law to\nthe contrary, the village board of the village of Cold Spring may, by\nadoption of a local law or ordinance, provide for a residential parking\npermit system and fix and require the payment of fees applicable to\nparking within the area in which such parking system is in effect in\naccordance with the provisions of this section.\n 2. Such residential parking permit system may only be established\nwithin the area of the village consisting of the following roadways on\nthe west side of the metro north train station: Main Street, New Street,\nWest Street, Fish Street and Market Street and on the following roadways\non the east side of the metro north train station: Main Street from\nMetro North Tracks to Parsonage Street, Academy Street, B Street,\nBenedict Road, Cherry Street, East Belvedere Street, Fishkill Avenue,\nFurnace Street, Garden Street, Grandview Terrace, Hamilton Street, High\nStreet, Kemble Avenue from Main Street to Wall Street, Locust Ridge,\nMaple Terrace, Marion Avenue, Mountain Avenue, Orchard Street, Parrot\nStreet, Parsonage Street, Paulding Avenue, Pine Street, Railroad Avenue,\nStone Street, West Belvedere Street, Whitehill Place, Church Street,\nHaldane Street, Rock Street, Cross Street and Northern Avenue.\n 3. Notwithstanding the foregoing, no permit shall be required on those\nportions of such streets where the adjacent properties are zoned for\ncommercial/retail use.\n 4. The local law or ordinance providing for such residential parking\nsystem shall:\n (a) set forth factors necessitating the enactment of such parking\nsystem;\n (b) provide that motor vehicles registered pursuant to section four\nhundred four-a of this chapter shall be exempt from any permit\nrequirement;\n (c) provide the times of the day and days of the week during which\npermit requirements shall be in effect;\n (d) make not less than twenty percent of the spaces within the permit\narea available to nonresidents, and shall provide short term parking of\nnot less than one hundred twenty minutes in duration in the permit area;\n (e) provide the schedule of fees to be paid for such permits; and\n (f) provide that such fees shall be credited to the general fund of\nthe village unless otherwise specified in such local law.\n 5. No ordinance shall be adopted pursuant to this section until a\npublic hearing thereon has been had in the same manner as required for\npublic hearings on a local law pursuant to the municipal home rule law.\n * NB There are 2 § 1640-h's\n
