Such residential parking permit system may only be established\nwithin:\n (a) the Tibbetts Brook Park area of the city of Yonkers which shall\nmean that area generally bounded by Harrison Avenue proceeding south\nfrom Tibbetts Brook Park to Alan B. Shepard Place; Tibbetts Road\nproceeding southerly from Tibbetts Brook Park to Alan B. Shepard Place;\nSedgewick Avenue proceeding southerly from Tibbetts Brook Park to Alan\nB. Shepard Place; Jervis Road between Harrison Avenue and Sedgewick\nAvenue and from the northern intersection of Sedgewick Avenue proceeding\nsoutherly along Jervis Road to the Alan B. Shepard Place line; and\n (b) the Yonkers Raceway/Empire City area of the city of Yonkers\nconsisting of the following roadways:\n (i) Belmont Avenue from Orient Street to Yonkers Avenue;\n (ii) Boone Street from Central Park Avenue to Dead End;\n (iii) Clark Street from Central Park Avenue to Orient Street;\n (iv) Loring Avenue from Central Park Avenue to Orient Street; and\n (v) Chamberlain Avenue from Belmont Avenue to Central Park Avenue.\n 3. Notwithstanding the foregoing, no permit shall be required on\nstreets where the adjacent properties are zoned for commercial/retail\nuse.\n 4. The local law or ordinance providing for such residential parking\nsystem shall:\n (a) set forth factors necessitating the enactment of such parking\nsystem; and\n (b) provide that motor vehicles registered pursuant to section four\nhundred four-a of this chapter shall be exempt from any permit\nrequirement; and\n (c) provide the times of the day and days of the week during which\npermit requirements shall be in effect; and\n (d) make not less than twenty percent of all spaces within the permit\narea available to non-residents and shall provide for short-term parking\nof not less than ninety minutes in duration in such area; and\n (e) provide the schedule of fees to be paid for such permits; and\n (f) provide that such fees shall be credited to the general fund of\nthe city.\n 5. No ordinance shall be adopted pursuant to this section until a\npublic hearing thereon has been had in the same manner as required for\npublic hearings on a local law pursuant to the municipal home rule law.\n * NB There are 2 § 1640-e's\n
