§ 1640-c. Residential parking system in the city of Rye. 1.\nNotwithstanding the provisions of any law to the contrary, the city\ncouncil of the city of Rye may, by adoption of a local law or ordinance,\nprovide for a residential parking permit system and fix and require the\npayment of fees applicable to parking within the area in which such\nparking system is in effect in accordance with the provisions of this\nsection.\n 2. Such residential parking permit system may only be established\nwithin the area of the city of Rye which shall mean that area generally\nbounded on the westerly side, by Blind Brook and Milton Harbor; on the\nsoutherly side, by Milton Point; on the easterly side, by Long Island\nSound; and on the northerly side, by the northerly side of Apawamis\nAvenue as extended by imaginary lines easterly from its point of\nintersection with Forest Avenue to Long Island Sound, and westerly from\nits point of intersection with Milton Road to Blind Brook.\n 3. Notwithstanding the foregoing, no permit shall be required on\nstreets where the adjacent properties are zoned for commercial/retail\nuse.\n 4. The local law or ordinance providing for such residential parking\nsystem shall:\n (a) set forth factors necessitating the enactment of such parking\nsystem; and\n (b) provide that motor vehicles registered pursuant to section four\nhundred four-a of this chapter shall be exempt from any permit\nrequirement; and\n (c) provide the times of the day and days of the week during which\npermit requirements shall be in effect; and\n (d) make not less than twenty percent of all spaces with in the permit\narea available to non-residents and shall provide for short-term parking\nof not less than ninety minutes in duration in such area; and\n (e) provide the schedule of fees to be paid for such permits; and\n (f) provide that such fees shall be credited to the general fund of\nthe city.\n 5. No ordinance shall be adopted pursuant to this section until a\npublic hearing thereon has been had in the same manner as required for\npublic hearings on a local law pursuant to the municipal home rule law.\n
