§ 1640-d. Residential parking system in the village of Pelham in the\ncounty of Westchester.
1.Notwithstanding the provisions of any law to\nthe contrary, the village board of the village of Pelham may, by\nadoption of a local law or ordinance, provide for a residential parking\npermit system and fix and require the payment of fees applicable to\nparking within the area in which such parking system is in effect in\naccordance with the provisions of this section.\n 2. Such residential parking permit system may only be established\nwithin the area of the village consisting of the following roadways:\n (a) the east side of Wolfs Lane, from Franklin Place to Boulevard;\n (b) the south side of Boulevard West, from Wolfs Lane to the city of\nMount Vernon boundary;\n (c) both sides of Fift

Such residential parking permit system may only be established\nwithin the area of the village consisting of the following roadways:\n (a) the east side of Wolfs Lane, from Franklin Place to Boulevard;\n (b) the south side of Boulevard West, from Wolfs Lane to the city of\nMount Vernon boundary;\n (c) both sides of Fifth Avenue, from Sixth Street to Willow Avenue;\n (d) both sides of NYAC Avenue, from Franklin Avenue to Second Street;\n (e) both sides of Corlies Avenue, from Colonial Avenue to Second\nStreet;\n (f) both sides of Pelhamdale Avenue, from Colonial Avenue to Irving\nPlace;\n (g) both sides of Highbrook Avenue, from Colonial Avenue to Irving\nPlace;\n (h) both sides of Boulevard, from Wolfs Lane to Highbrook Avenue;\n (i) both sides of Seventh Street, from the west end of Seventh Street\n(dead end) to Sixth Avenue;\n (j) both sides of Fourth Avenue, from Seventh Street to the dead end;\n (k) both sides of Harmon Avenue, from Fifth Avenue to Harmon Place;\n (l) the north side of First Street, from Wolfs Lane to Corlies Avenue;\n (m) the west side of NYAC Avenue, two hundred feet south of the\nintersection with First Street to East Second Street;\n (n) the east side of Fourth Avenue, from First Street to Second\nStreet;\n (o) the west side of First Avenue, from First Street to Third Street.\n 3. Notwithstanding the foregoing, no permit shall be required on those\nportions of such streets where the adjacent properties are zoned for\ncommercial/retail use.\n 4. The local law or ordinance providing for such residential parking\nsystem shall:\n (a) set forth factors necessitating the enactment of such parking\nsystem;\n (b) provide that motor vehicles registered pursuant to section four\nhundred four-a of this chapter shall be exempt from any permit\nrequirement;\n (c) provide the times of the day and days of the week during which\npermit requirements shall be in effect;\n (d) make not less than twenty percent of the spaces within the permit\narea available to nonresidents, and shall provide short term parking of\nnot less than one hundred twenty minutes in duration in the permit area;\n (e) provide the schedule of fees to be paid for such permits; and\n (f) provide that such fees shall be credited to the general fund of\nthe village unless otherwise specified in such local law.\n 5. No ordinance shall be adopted pursuant to this section until a\npublic hearing thereon has been had in the same manner as required for\npublic hearings on a local law pursuant to the municipal home rule law.\n
