Text
(a)It is unlawful for any person to commit Medicaid fraud as prohibited by § 5-55-111 .
(b)Medicaid fraud is a:
(1)Class C felony if the aggregate amount of payments illegally claimed is two thousand five hundred dollars ($2,500) or more but less than five thousand dollars ($5,000);
(2)Class B felony if the aggregate amount of payments illegally claimed is five thousand dollars ($5,000) or more but less than twenty-five thousand dollars ($25,000); and (3) Class A felony if the aggregate amount of payments illegally claimed is twenty-five thousand dollars ($25,000) or more.
(c)Otherwise, Medicaid fraud is a Class A misdemeanor.
