Text
(a)A person commits aggravated residential burglary if he or she commits residential burglary as defined in § 5-39-201 of a residential occupiable structure, and either:
(1)The residential occupiable structure is occupied by another person; or (2) He or she is armed with a deadly weapon or represents by word or conduct that he or she is armed with a deadly weapon.
(b)Aggravated residential burglary is a:
(1)Class Y felony if:
(A)Committed under subdivision (a)(2) of this section; or (B) The person causes or attempts to cause death or serious physical injury to another person; or (2) Class A felony if otherwise committed.
