§ 103. General functions, powers and duties of council. The council\nshall have the following functions, powers and duties:\n 1. To advise the governor and the legislature with regard to programs\nfor the regulation and control of atomic energy activities, and to make\nrecommendations to the governor and the legislature designed to assure\nthat the regulatory programs of the state, including its political\nsubdivisions, affecting atomic energy activities encourage the\ndevelopment and use of atomic energy for peaceful purposes within the\nstate, while fully protecting the interest, health and safety of the\npublic.\n 2. To advise the governor and the legislature with regard to programs\nfor the regulation and control of atomic energy activities, and to make\nrecommendations to the governor and the legislature designed to assure\nthat the regulatory programs of the state, including its political\nsubdivisions, affecting atomic energy activities encourage the\ndevelopment and use of atomic energy for peaceful purposes within the\nstate, while fully protecting the interest, health and safety of the\npublic.\n 2. To coordinate the regulatory programs of the agencies, and\ninstrumentalities of the state and its political subdivisions and\nagencies of such subdivisions, affecting atomic energy activities, and\nto correlate such programs with the regulatory programs of the federal\ngovernment and other states.\n 4. To develop a coordinated position with respect to regulatory\nprograms of the federal government affecting atomic energy activities in\nthe state, taking into account the interests of all agencies and\ninstrumentalities of the state and its political subdivisions, and\nagencies of such subdivisions; to coordinate the participation of all\nsuch bodies in the regulatory processes of the federal government\nrelating to such regulatory programs; and to coordinate the presentation\nof views concerning such regulatory programs of all such bodies for\nconsideration by the federal government.\n 5. To consider, in cooperation and consultation with appropriate\nofficials of other states, existing interstate compacts relating to\nregulation of atomic energy activities and adaptations, modifications or\nchanges of such compacts and new compacts or other arrangements for\ncooperation, coordination or joint or mutual action by this state and\nother states, with respect to regulation of atomic energy activities,\nand to make such recommendations with respect thereto to the governor\nand the legislature as the council deems appropriate.\n 6. To carry out the obligations of the state to the New York state\natomic and space development authority under any contract providing for\nthe assumption of jurisdiction in the event of conditions specified in\nany such contract over land and facilities held or developed by such\nauthority for the concentration and storage of radioactive byproducts;\nto enter into amendments to any such contract subject to the approval of\nthe director of the budget; and, after any such assumption of\njurisdiction by the council, pursuant to any such contract or\namendments, to operate, develop and manage in the name of the state such\nland and facilities, and to care for, manage, use and dispose of any\nradioactive byproducts concentrated or stored at such land and\nfacilities.\n 7. To review periodically the programs of the agencies and\ninstrumentalities of the state and political subdivisions thereof, and\nagencies of such subdivisions, for responding, handling and providing\nassistance, in the event of an accident, fire or disaster believed to\ninvolve radioactive materials and to make such recommendations with\nrespect to such programs as the council deems appropriate to such\nbodies.\n
