TRUMP, : 23 Civ. 3773 (AKH) Defendant(s). ee ee ee ALVIN K. HELLERSTEIN, U.S.D.J.: Lewis Brooks McKenzie moves to intervene in this case. He seeks intervention in order to certify a “constitutional question” to the Second Circuit Court of Appeals. The question relates to the lawfulness of the underlying indictment of Donald J. Trump. McKenzie’s motion to intervene is denied. McKenzie cites no federal statute giving him the right to intervene, He claims no “interest relating to the property or transaction that is the subject of the action, and is [not] so situated that disposing of the action may as a practical matter impair or impede [his] ability to protect [his] interest.” Nor does he state a claim or defense that shares a common question of law or fact with the main action. The conditions of Fed, R. Civ. P. 24 are not satisfied. That McKenzie is a citizen, and has the right to vote, and wishes to add his thoughts to Defendant’s defenses does not satisfy Rule 24. Since McKenzie has no right to intervene, he has no right to have questions certified to the Court of Appeals.
