§ 2021 — Payment of fines, disposition thereof and related matters

* § 2021. Payment of fines, disposition thereof and related matters.\n 1. A fine imposed and paid before commitment, must be received by the\ncourt, and unless otherwise provided by law, shall be the property of\nthe town in which the offense was committed if the fine was imposed by a\ntown court. If, however, the fine was imposed by a village court for an\noffense committed in a village, then, unless otherwise provided by law,\nthe fine shall be the property of the village in which the offense was\ncommitted. All such fines shall be paid to the state comptroller by the\ncourt on or before the tenth day of the month next succeeding their\ncollection. Notwithstanding the foregoing provisions of this\nsubdivision, all fines imposed for the violation of a village local law,\nordinance or regulation, unless otherwise provided by law, shall be the\nproperty of such village, whether or not the village has established the\noffice of village justice.\n 2. If the defendant is committed in default of the payment of a fine,\nhe may pay it, and any surcharge and/or crime victim assistance fee, to\nthe sheriff or superintendent or municipal official of the facility to\nwhom the defendant was committed who shall, within thirty days after the\nreceipt thereof, unless otherwise provided by law, pay the same to the\njustice of the court that rendered the conviction.\n * NB There are 2 § 2021's\n
