* § 412. Program, finance, and administration committee.
1.The\ncouncil shall establish a program, finance, and administration\ncommittee, to be composed of staff representatives of the New York state\ndepartment of transportation, the metropolitan transportation authority,\nand one to be appointed by each of the transportation coordinating\ncommittees. The central staff director shall serve as secretary to the\ncommittee. The co-chairpersons of the council shall appoint the\nchairperson of the committee from among the committee members.\n 2. The program, finance and administration committee shall be\nresponsible for overseeing day-to-day operations of the metropolitan\nplanning organization, including the following activities:\n (a) monitoring and coordinating progress of the council

* § 412. Program, finance, and administration committee. 1. The\ncouncil shall establish a program, finance, and administration\ncommittee, to be composed of staff representatives of the New York state\ndepartment of transportation, the metropolitan transportation authority,\nand one to be appointed by each of the transportation coordinating\ncommittees. The central staff director shall serve as secretary to the\ncommittee. The co-chairpersons of the council shall appoint the\nchairperson of the committee from among the committee members.\n 2. The program, finance and administration committee shall be\nresponsible for overseeing day-to-day operations of the metropolitan\nplanning organization, including the following activities:\n (a) monitoring and coordinating progress of the council's unified\nplanning work program to assure adherence to budgets and consistency\nwith federal regulations and local, state and federal objectives, and\n (b) minor revisions to budgets and other aspects of the work program,\nas necessary during the program year.\n 3. The program, finance and administration committee shall, in\ncooperation with the transportation coordinating committees, develop\nannually a draft unified planning work program consistent with the\nrequirements of 23 CFR 450 and 49 CFR 613, for recommendation for\nendorsement by the council at the council's annual meeting. The work\nprogram shall include central and subregional staff activities, council\nmember activities, and special studies.\n 4. Upon the initiation by any council member of a project of\nregionwide significance through the appropriate transportation\ncoordinating committees, or changes to such projects, which must receive\nmetropolitan planning organization endorsement during the interval\nbetween council meetings, the program, finance and administration\ncommittee shall be authorized to act for the council to include such\nproject or make such changes with respect thereto in the council's\ntransportation improvement program. To the extent possible such\ntransportation improvement program changes shall be recommended by the\nprogram, finance and administration committee to the council at its next\nmeeting. In the case that approval of affected transportation\ncoordinating committees cannot be secured, then the council shall meet\nto decide the issue.\n 5. Upon the endorsement by a transportation coordinating committee of\na change in its transportation improvement program, which change must\nfor some reason be incorporated in the council program during the\ninterval between the council's annual meetings, the program, finance and\nadministration committee shall be authorized to act for the council to\nmake such incorporation and shall make such incorporation, provided that\nthe change is consistent with plans adopted by the council.\n 6. Upon the request of any council member of a change in the council's\nunified planning work program, including the program budget or budgets,\nwhich for some reason must receive metropolitan planning organization\nendorsement during the interval between the council meetings, the\nprogram, finance and administration committee shall be authorized to act\nfor the council to make such a change. All actions taken by the program,\nfinance and administration committee concerning the unified planning\nwork program shall be reported to all council members within five\nworking days. Such actions shall be effective unless a negative response\nis received from a council member within ten working days.\n * NB Expired June 30, 1983\n
