* § 95-k. Lyme and tick-borne diseases education, research and\nprevention fund.
1.There is hereby established in the joint custody of\nthe commissioner of taxation and finance and the comptroller, a special\nfund to be known as the "Lyme and tick-borne diseases education,\nresearch and prevention fund".\n 2. Such fund shall consist of all revenues received by the department\nof taxation and finance, pursuant to the provisions of section two\nhundred nine-P and section six hundred thirty-k of the tax law, and all\nother moneys appropriated, credited or transferred thereto from any\nother fund or source pursuant to law. * § 95-k. Lyme and tick-borne diseases education, research and\nprevention fund. 1. Monies of the fund shall be expended solely for Lyme and tick-borne\ndiseases education, research and prevention approved by the department\nof health of the state of New York, for the purpose of promoting\neducation, research and prevention of Lyme and tick-borne diseases.\n 4. Monies shall be payable from the fund on the audit and warrant of\nthe comptroller on vouchers approved and certified by the commissioner\nof the department of health.\n 5. To the extent practicable, the commissioner of the department of\nhealth shall ensure that all monies received during a fiscal year are\nexpended prior to the end of such fiscal year.\n 6. On or before the first day of February each year, the comptroller\nshall certify to the governor, temporary president of the senate,\nspeaker of the assembly, minority leader of the senate, minority leader\nof the assembly, chair of the senate finance committee and chair of the\nassembly ways and means committee, the amount of money deposited in the\nLyme and tick-borne diseases education, research and prevention fund\nduring the preceding calendar year as the result of revenue derived\npursuant to sections two hundred nine-P and six hundred thirty-k of the\ntax law.\n 7. On or before the first day of February each year, the commissioner\nof the department of health shall provide a written report to the\ntemporary president of the senate, speaker of the assembly, minority\nleader of the senate, minority leader of the assembly, chair of the\nsenate finance committee, chair of the assembly ways and means\ncommittee, chair of the senate committee on health, and chair of the\nassembly health committee. Such report shall include how the monies of\nthe fund were utilized during the preceding calendar year and shall\ninclude:\n (i) the amount of money dispersed from the fund;\n (ii) recipients of awards from the fund;\n (iii) the amount awarded to each; and\n (iv) the purposes for which such awards were granted.\n * NB There are 2 § 95-k's\n
