The New York state autism awareness and research fund. 1.\nThere is hereby established in the joint custody of the commissioner of\ntaxation and finance and the comptroller, a special fund to be known as\nthe New York state autism awareness and research fund.\n 2. Nothing contained\nin this section shall prevent the state from receiving grants, gifts or\nbequests for the purposes of the fund as defined in this section and\ndepositing them into the fund according to law.\n 2-a. On or before the first day of February each year, the\ncommissioner of the office for people with developmental disabilities\nshall provide a written report to the temporary president of the senate,\nspeaker of the assembly, chair of the senate finance committee, chair of\nthe assembly ways and means committee, chair of the senate committee on\nhealth, chair of the assembly health committee, the state comptroller\nand the public. Such report shall include how the monies of the fund\nwere utilized during the preceding calendar year, and shall include:\n (i) the amount of money disbursed from the fund and the award process\nused for such disbursements;\n (ii) recipients of awards from the fund;\n (iii) the amount awarded to each;\n (iv) the purposes for which such awards were granted; and\n (v) a summary financial plan for such monies which shall include\nestimates of all receipts and all disbursements for the current and\nsucceeding fiscal years, along with the actual results from the prior\nfiscal year.\n 3. (a) Monies of the fund shall be expended only for autism awareness\nprojects or autism research projects approved by the office for people\nwith developmental disabilities in New York state provided, however,\nthat no more than ten percent of monies from such fund shall be expended\non the aggregate number of autism research projects approved in a fiscal\nyear.\n (b) As used in this section, the term "autism research project" means\nscientific research approved by the office for people with developmental\ndisabilities into the causes and/or treatment of autism, and the term\n"autism awareness project" means a project approved by the office for\npeople with developmental disabilities aimed toward educating the\ngeneral public about the causes, symptoms, and treatments of autism.\n 4. Monies shall be payable from the fund on the audit and warrant of\nthe comptroller on vouchers approved and certified by the commissioner\nof the office for people with developmental disabilities.\n 5. To the extent practicable, the commissioner of the office for\npeople with developmental disabilities shall ensure that all monies\nreceived during a fiscal year are expended prior to the end of that\nfiscal year.\n * NB There are 2 § 95-e's\n
