§ 10-102 — Military voters; definitions

§ 10-102. Military voters; definitions. As used in this article the\nfollowing terms have the following meanings.\n 1. "Military service" means the military service of the state, or of\nthe United States, including the army, navy, marine corps, air force,\nspace force, coast guard, merchant marine and all components thereof,\nand the coast and geodetic survey, the public health service, the\nnational guard when in the service of the United States pursuant to call\nas provided by law, and the cadets or midshipmen of the United States\nMilitary Academy, United States Naval Academy, United States Air Force\nAcademy, United States Merchant Marine Academy, and United States Coast\nGuard Academy.\n 2. "Military voter" means a qualified voter of the state of New York\nwho is in the actual military service, as defined in the preceding\nparagraph of this section, and by reason of such military service is\nabsent from his election district of residence on the day of\nregistration or election, or a voter who is discharged from such\nmilitary service within thirty days of an election and the spouse,\nparent, child or dependent of such voter accompanying or being with him\nor her, if a qualified voter and a resident of the same election\ndistrict.\n 3. "Military ballot" means the ballot prepared, printed and supplied\nfor use by the military voter for a general election, primary election\nor special election.\n 4. "Military address" means the mailing address of a military voter\nother than his residence address in his election district.\n 5. "Appropriate board of elections" means the board of elections in\nwhose jurisdiction the military voter resides as a qualified voter.\n
