§ 34-11-9-1 — New or continuing contract

Indiana·Title 34 CIVIL LAW AND PROCEDURE·Art. 11 LIMITATION OF ACTIONS·Ch. 9 Acknowledgment, New Promise, and Partial Payment

An acknowledgment or promise is not evidence of a new or continuing contract, for the purpose of taking the case out of the operation of this article, unless the acknowledgment or promise is:

(1)in writing; and
(2)signed by the party to be charged by the acknowledgment or promise. [Pre-1998 Recodification Citation: 34-1-2-10.]
