§ 1286. Operators to wear protective headgear.
1.No person sixteen or\nseventeen years of age shall ride upon, propel or otherwise operate an\nelectric scooter unless such person is wearing a helmet meeting\nstandards established by the commissioner pursuant to the provisions of\nsubdivision two-a of section twelve hundred thirty-eight of this title.\nAs used in this subdivision, wearing a helmet means having a properly\nfitting helmet fixed securely on the head of such wearer with the helmet\nstraps securely fastened.\n 2. Any person who violates the provisions of subdivision one of this\nsection shall pay a civil fine not to exceed fifty dollars.\n 3. The court shall waive any fine for which a person who violates the\nprovisions of subdivision one of this section would be liable if
