§ 1281. Traffic laws apply to persons operating electric scooters;\nlocal laws. 1. Every person riding an electric scooter upon a roadway\nshall be granted all of the rights and shall be subject to all of the\nduties applicable to the driver of a vehicle and the rider of a bicycle\nby this title, except as to special regulations in this article and\nexcept as to those provisions of this title which by their nature can\nhave no application.\n 2.

(a) Except as provided in paragraphs (b) and (c) of this\nsubdivision, the governing body of any city, town or village may, by\nlocal law or ordinance, further regulate the time, place and manner of\nthe operation of electric scooters, including, but not limited to,\nmaximum speed, requiring the use of protective headgear, and the wearing\nof readily visible reflective clothing or material by operators of\nelectric scooters, and may limit, prohibit the use thereof in specified\nareas, or prohibit entirely the use of electric scooters within such\ncity, town, or village, provided that adequate signage is visibly posted\noutside the boundaries of such prohibited areas.\n (b) The governing body of any city, town or village in the counties of\nNassau or Suffolk may, by local law or ordinance, further regulate the\ntime, place and manner of the operation of electric scooters, including,\nbut not limited to, maximum speed, requiring the use of protective\nheadgear, and the wearing of readily visible reflective clothing or\nmaterial by operators of electric scooters only after adoption of a\nlocal law or ordinance by the governing body of the county in which the\ncity, town or village is located. Provided, however, that the provisions\nof this paragraph shall not apply to the adoption of a local law or\nordinance by a city, town or village in the counties of Nassau or\nSuffolk pursuant to the provisions of paragraph (a) of this subdivision\nto prohibit the use of electric scooters in specified areas, or prohibit\nentirely the use of electric scooters within such city, town or village,\nprovided that adequate signage is visibly posted outside the boundaries\nof such prohibited areas.\n (c) The governing body of any town or village in the county of\nWestchester may, by local law or ordinance, further regulate the time,\nplace and manner of the operation of electric scooters, including, but\nnot limited to, maximum speed, requiring the use of protective headgear,\nand the wearing of readily visible reflective clothing or material by\noperators of electric scooters only after adoption of a local law or\nordinance by the governing body of Westchester county. Provided,\nhowever, that the provisions of this paragraph shall not apply to the\nadoption of a local law or ordinance by a town or village in the county\nof Westchester pursuant to the provisions of paragraph (a) of this\nsubdivision to prohibit the use of electric scooters in specified areas,\nor prohibit entirely the use of electric scooters within such town or\nvillage, provided that adequate signage is visibly posted outside the\nboundaries of such prohibited areas.\n 3. No person shall operate an electric scooter unless such operation\nis in compliance with the provisions of this chapter, and any regulation\nor order or local law or ordinance adopted pursuant to this article.\n
