* § 349-g. Airport access mass transit for LaGuardia airport. (a)\nNotwithstanding any other provision of law, general, special, charter or\nlocal, and consistent with section fourteen-d of the transportation law,\nif a property acquisition pursuant to this section occurs by eminent\ndomain, the commissioner of transportation shall have the authority to\nacquire any property, property rights, or property interests, including\neasements, air rights and subsurface rights whether or not now or\npreviously designated as parkland or otherwise dedicated to a public use\nas parkland (hereinafter referred to as "property interests"), but only\nto the extent that such property interests are, in the judgment of the\ncommissioner, necessary for the construction, use, occupancy, operation,\nand maintenance of an airport access mass transit facility via an\nelevated guideway for LaGuardia airport and related ancillary facilities\nfor airport access mass transit maintenance, parking for persons using\nthe airport access mass transit facility and additional limited purposes\ndirectly related to operation of an airport access mass transit project\nand additional limited purposes directly related to the operation of an\nairport access mass transit project, temporary laydown and construction\nareas and air rights and subsurface rights related to an elevated\nguideway, including appropriate entry and exit points for users of the\nairport access mass transit facility and any property interests\nnecessary for an adjustment of the piers supporting the pedestrian\nbridges crossing the Grand Central Parkway to maintain accessibility,\nand any vehicle entry and exit points to the Grand Central Parkway\nlocated along either side of the corridor, running along a route from\nLaGuardia airport on or near the Grand Central Parkway, thence along the\nedge of the Citi Field parking lot previously alienated for stadium use,\nnext alongside the existing elevated track for the No. 7 subway and\nterminating at subway rail yards and other transportation staging and\nstorage areas within a corridor more specifically defined pursuant to\nsubdivision (b) of this section; and to utilize or sell, lease,\ncontract, or otherwise transfer the acquired property interests together\nwith property interests the commissioner otherwise holds and/or grant\neasements, licenses, permits, concessions or other authorizations, to\nthe Port Authority of New York and New Jersey, to facilitate the\nconstruction (including temporary laydown), and permanent use,\noccupancy, operation, and maintenance of the airport access mass transit\nfacility and related ancillary facilities for airport access transit\nmaintenance, parking for persons using the airport access transit\nfacility and additional limited purposes directly related to operation\nof an airport access mass transit project, and additional limited\npurposes directly related to operation of an airport access mass transit\nproject including appropriate entry and exit points for users of the\nmass transit facility and any property interests necessary for an\nadjustment of the piers supporting the pedestrian bridges crossing the\nGrand Central Parkway to maintain accessibility, and any vehicle entry\nand exit points to the Grand Central Parkway located along either side\nof the corridor, and temporary use for laydown and construction\npurposes; provided however, this section does not authorize acquisition\nof property interests for a self-standing facility constructed to house\npremises for automobile rental operations.\n (b) The corridor defined in subdivision (a) of this section, where the\nacquisition of such property, property rights, or property interests\nreferred to in this section may occur, is more particularly described as\nfollows:\n (i) The following parcels shall be included within a corridor within\nwhich acquisition of permanent property interests may be acquired for\npurposes of this section and paragraph d of subdivision one of section\nfourteen-d of the transportation law:\n(A) Parcel A\nAll that certain tracts or parcels of land located in the Borough of\nQueens, State of New York, bounded and described as follows:\nTract 1 - Grand Central Parkway\nBeginning at a point in the easterly right of way line of Ditmars\nBoulevard at the southwest corner of Tax Map Lot 50 Block 1641, thence\nalong a line North 15Á-10'-31" East, a distance of 493.53' to a point\nwithin the westerly line of Tax Map Lot 1 Block 926, and from said point\nof beginning running thence:\n 1. Within the westbound lanes of the Grand Central Parkway South\n07Á-53'-31" East, a distance of 114.46' to a point within the westbound\nlanes of the Grand Central Parkway\n 2. Along the southerly line of Tax Map Lot 1500 Block 2018 North\n68Á-30'-37" East, a distance of 241.71' to the point and place of\nbeginning and containing a calculated areas of 236,272.08 SF or 5.424\nacres.\n (F) Any property interests necessary for an adjustment of the piers\nsupporting the pedestrian bridges crossing the Grand Central Parkway to\nmaintain accessibility, and any vehicle entry and exit points to the\nGrand Central Parkway located along either side of the above described\ncorridor.\n (c) Notwithstanding any other provision of law, general, special,\ncharter or local, following acquisition, the commissioner of\ntransportation may use such property interests together with property\ninterests already owned or held within the corridor described in\nsubdivision (b) of this section or enter into contracts to sell, or\nlease to, contract with or otherwise transfer to, and/or exchange with,\nand/or grant easements, licenses, permits, concessions, or other\nauthorizations to, the Port Authority of New York and New Jersey, to\nconstruct (including utilizing temporary laydown areas), and permanently\nuse, occupy, operate, and maintain the airport access mass transit\nfacility, related ancillary facilities for airport access mass transit\nmaintenance, parking for persons using the airport access mass transit\nfacility and additional limited purposes directly related to operation\nof an airport access mass transit project; provided however, this\nsection does not authorize use of property interests for a self-standing\nfacility constructed to house premises for automobile rental operations;\nand provided further that, the Port Authority of New York and New Jersey\nmay, notwithstanding any other provision of law, general, special,\ncharter or local, transfer any property interests to the city of New\nYork, in accordance with the terms and conditions for the lease of\nairport premises by the city of New York to the Port Authority of New\nYork and New Jersey and the city of New York may, following such\ntransfer, leaseback the property interests under those terms and\nconditions.\n (d) Upon completion of any modifications to the Grand Central Parkway,\nthe commissioner of transportation shall by official order transfer\njurisdiction over the central express artery and adjacent landscape\nareas and over adjacent service roads to the city of New York as set\nforth in subdivision 3.4 of section three hundred forty-nine-c of this\narticle.\n (e) Authorization is hereby given to the commissioner of\ntransportation to do all things necessary, within the judgment of the\ncommissioner, to carry out the purposes of this section.\n (f) During the construction of any airport access mass transit\nfacility for LaGuardia airport and related ancillary facilities on any\nproperty interests acquired pursuant to this section, section fourteen-d\nof the transportation law, or pursuant to any other section of law, the\nconstructing party shall provide for the on-going monitoring of\nvibrations, noise and air quality during construction.\n (g) The constructing party shall ensure the provision of just\ncompensation to a property owner of any property or building within the\nvicinity of the construction of any airport access mass transit facility\nfor LaGuardia airport and related ancillary facilities that has been\nphysically damaged as a result of action taken by the constructing party\nor its agent during such construction, however, nothing herein shall\nestablish a cause of action for such damages.\n * NB Repealed June 25, 2028 only if no property interests have been\nacquired pursuant to chapter 78 of 2018\n
