§ 27-1101. Definitions.\n As used in this title, unless the context otherwise requires:\n 1. "Person" means any individual, public or private corporation,\npolitical subdivision, government agency, industry, partnership,\nassociation, firm, trust, estate or any other legal entity whatsoever.\n 2. "Industrial hazardous waste treatment, storage and disposal\nfacility" shall mean a specialized facility or site other than a\nlow-level radioactive waste management facility subject to the\nprovisions of article twenty-nine of this chapter, or a sewage treatment\nfacility for the purpose of treating, storing, compacting, recycling,\nexchanging, or disposing of industrial hazardous waste materials,\nincluding treatment, compacting, resource recovery or disposal plants,\nequipment and furnishings thereof used for the storage, treatment,\ncompacting, composting, shredding, coverting, utilization, processing,\nor final disposal of hazardous waste, including but not limited to\nmechanical, chemical or thermal processing systems, incinerators,\nsanitary landfills, other facilities for the storage, reduction or\nconversion of hazardous waste, including but not limited to transfer\nstations, baling facilities, railroad and maritime facilities, motor\ntrucks or vehicles and appurtenances, furnishings, equipment and\nmachinery deemed necessary thereto.\n 6. "Municipality" means any town, city, county or village.\n 7. "Treatment" means any method, technique, or process including\nneutralization, designed to change the physical, chemical or biological\ncharacter or composition of any hazardous waste so as to neutralize such\nwaste or as to render such waste nonhazardous, safer for transport,\namenable for recovery, amenable for storage, or reduced in volume.\n 8. "Storage" means the containment of hazardous waste, either on a\ntemporary basis or for a period of years, in such a manner as not to\nconstitute disposal of such hazardous waste.\n 9. "Disposal" means the abandonment, discharge, deposit, injection,\ndumping, spilling, leaking or placing of any substance so that such\nsubstance or any related constituent thereof may enter the environment.\nDisposal also means the thermal destruction of waste or hazardous waste\nand the burning of such wastes as fuel for the purpose of recovering\nuseable energy.\n 10. "Environment" means any water, water vapor, any land including\nland surface or subsurface, air, fish, wildlife, biota and all other\nnatural resources.\n 11. "Preferred hazardous waste management practices hierarchy" shall\nmean that policy established in section 27-0105 of this article.\n
