§ 27-0405. New York state local resource reuse and development program.\n 1. The department shall design and actively implement a local resource\nreuse and development program which shall promote the collection,\nintermediate processing and marketing of waste materials that are now\nbeing disposed of as municipal solid waste in New York state. The\nprogram shall:\n (a) promote the development and implementation of resource reuse\nprograms by municipalities;\n (b) serve as a clearinghouse for information regarding existing\nmunicipal resource reuse programs;\n (c) identify special needs and problems facing municipalities in\ndeveloping and implementing resource reuse programs, and recommend\napproaches and solutions to address such identified needs and problems;\nand\n (d) provide othe

§ 27-0405. New York state local resource reuse and development program.\n 1. The department shall design and actively implement a local resource\nreuse and development program which shall promote the collection,\nintermediate processing and marketing of waste materials that are now\nbeing disposed of as municipal solid waste in New York state. The\nprogram shall:\n (a) promote the development and implementation of resource reuse\nprograms by municipalities;\n (b) serve as a clearinghouse for information regarding existing\nmunicipal resource reuse programs;\n (c) identify special needs and problems facing municipalities in\ndeveloping and implementing resource reuse programs, and recommend\napproaches and solutions to address such identified needs and problems;\nand\n (d) provide other technical assistance to municipalities seeking to\ndevelop and implement resource reuse programs.\n 2. The program shall provide funding for up to seventy-five percent of\nthe cost of municipal resource reuse programs, including the cost of\nplanning, designing, coordinating and implementing collection,\nprocessing, marketing, public participation, promotional and other\nactivities essential to carrying out the program. Funds shall be made\navailable for one or more of the following purposes:\n (a) an analysis of the municipal waste stream;\n (b) a preliminary market survey to identify:\n (1) firms in the region that currently process, broker, market or\notherwise engage in resource reuse activities, and\n (2) the quantity of additional waste materials that current markets\ncould absorb;\n (c) development and distribution of information based on the operation\nof the program and the related materials and market considerations;\n (d) support of a local resource reuse coordinator who will be\nresponsible for overseeing development and implementation of the\nmunicipal resource reuse program. Duties shall include coordinating\nmunicipal collection, intermediate processing and marketing efforts with\nexisting local, regional and state resource reuse and market development\nefforts; and\n (e) development of a comprehensive resource reuse public education and\npromotion campaign to inform residents regarding the need for and\noperation of local resource reuse efforts and to increase public\nawareness of the benefits to be accrued from utilizing reused and\nrecycled products. The promotional campaign shall include, but need not\nbe limited to:\n (1) public education and outreach activities such as: magazine,\nnewspaper, television, radio and public transportation advertisements\nand public informational meetings and seminars; and\n (2) dissemination of public information materials providing the\ndetails of the municipal program including, but not limited to items to\nbe collected, collection locations and schedules.\n 3. The department shall receive applications for assistance from a\nmunicipality, acting alone or in conjunction with one or more other\nmunicipalities. Applications shall be evaluated based on the following\ncriteria:\n (a) energy savings of the proposal;\n (b) technical feasibility of the proposal;\n (c) municipal government commitment to the program;\n (d) whether the applicant has pursued other sources of funding,\nincluding, but not limited to funding available under title nine of\narticle fifty-one of this chapter; and\n (e) demonstrated ability of the applicant to carry out the proposed\nprogram.\n 4. In evaluating proposals, the department shall consider the\npotential for coordination and consolidation of solid waste practices\namong municipalities within specified areas or regions, and shall\nencourage such cooperation and consolidation where it is practicable and\nwould result in enhanced energy savings, environmental protection and\ncost effectiveness.\n
