§ 161 — Definitions

§ 161. Definitions. As used in this article:\n 1. The words "nursery stock" shall apply to and include all trees,\nshrubs, plants and vines and parts thereof.\n 2. The words "insect pests" mean insects injurious to plant and plant\nproducts.\n 3. The words "plant and plant products" mean trees, shrubs, vines,\nannuals, biennials, perennials, vegetables, fruit, forage and cereal\nplants and all other plant cuttings, grafts, scions, buds and all other\nparts of plants, and fruit, vegetables, roots, bulbs, seeds, wood and\nlumber.\n 4. The words "plant diseases" mean fungi, bacteria, nematodes, viruses\nand plant parasites injurious to plants and plant products, and the\npathological condition in plants and plant products caused by fungi,\nbacteria, nematodes, viruses and plant parasites.\n 5. The word "nursery" means the grounds and premises, private or\npublic, on or in which nursery stock is propagated, grown or cultivated\nfor the purpose of distribution or selling the same as a business and\nshall include grounds or premises owned, leased or managed by the state\nor any agency of the state government, and the owner or operator of such\nbusiness shall be a "nursery grower"; provided, however, that the term\n"nursery grower" shall not include persons engaged in the part-time\nproduction of plant products not sold in the regular channels of\nbusiness.\n 6. The words "nursery dealer" mean any person, firm, partnership,\nassociation or corporation not a grower or an original producer of\nnursery stock in this state which or who buys, or acquires, or receives\non consignment nursery stock for the purpose of reselling, transporting,\nor otherwise disposing of the same.\n 7. The word "soil" means the commonly accepted medium or other medium\nin which plants are grown and which is or may be capable of harboring or\ntransmitting insect pests and plant diseases.\n 8. The words "indoor plants" mean plants which are used for decorative\npurposes because of their flowering, fruiting or foliar characteristics\nand which cannot be grown and maintained throughout all seasons in the\noutdoor environment of this state.\n 9. The words "noxious weeds" means any living stage (including but not\nlimited to, seeds and reproductive parts) of any parasitic or other\nplant of a kind, or subdivision of a kind, which is of foreign origin,\nis new to or not widely prevalent in this state, and can directly or\nindirectly injure crops, other useful plants, livestock, or poultry or\nother interests of agriculture, including irrigation.\n
