The governor, with advice of the council, may appoint a commission of 3 persons who, upon hearing, shall determine whether there is occasion for the state to own any lands or water rights that are needed for fish and game department uses for the protection and management of wildlife resources and implementation of department programs, and if so, the commission may purchase land or other property in the proposed location. Such lands or water rights shall be in a location proposed by the executive director of the fish and game department. Any such land or property which cannot be acquired by agreement with the owner or owners thereof may be acquired in accordance with RSA 498-A.
