§ 34-12-5-2 — Application generally
Indiana·Title 34 CIVIL LAW AND PROCEDURE·Art. 12 PROHIBITED CAUSES OF ACTION·Ch. 5 Prohibited Class Actions Based on Contract Arising from
(a)This chapter applies to a claim arising from
COVID-19 during a period of a state disaster emergency declared
under IC 10-14-3-12 to respond to COVID-19, if the state of disaster
emergency was declared:
(1)after February 29, 2020; and
(2)before April 1, 2022.
(b)This chapter does not:
(1)create a cause of action;
(2)eliminate a required element of any existing cause of action;
(3)affect a worker's compensation claim under IC 22-3; or
(4)except as otherwise provided in this chapter, amend, repeal,
alter, or affect any immunity, defense, limitation of liability, or
procedure available or required under law or contract.
