INTRODUCTION In 1970, Congress enacted the Racketeer Influenced and Corrupt Organizations Act, 18 U.S.C. §§ 1961-1968. This Act is commonly referred to as the RICO statute. In enacting this statute, Congress’s intent was to give federal law enforcement new tools to combat organized crime. But as part of the statute, Congress also created civil remedies for persons injured in their business or property by a violation of prohibited activities described in RICO. These persons can sue in a United States District Court for money damages and other relief. For a person initially to

sustain a claim under RICO, specific elements of this claim must be alleged in the Complaint and related documents. When a Motion to Dismiss is filed by a defendant under Federal Rule of Civil Procedure
