§ 15-6-441 — Assessments and contracts; when valid and enforceable
(a)If the governing body has made any contract for any
local improvement or makes any assessment against property
within any local improvement district and has in making the
contract or assessment acted in good faith and without fraud,
the contract and assessment is valid and enforceable, and the
assessment is a lien upon the property involved.
(b)No objection to the validity of the contract or
assessment may be made on the ground that:
(i)The contract for the improvement was not awarded
in the manner or at the time required by law;
(ii)The assessment was made by an unauthorized
officer or person, if it has been confirmed by the governing
body;
(iii)The contract or assessment is based upon a
front foot basis or upon a basis of benefits to the property
within the district, unless it ap
