Text
A notarial officer commits a misdemeanor punishable by
imprisonment for not more than six (6) months, a fine of not
more than seven hundred fifty dollars ($750.00), or both, if he
signs and affixes his stamp to a certificate of acknowledgment
when the party executing the instrument has not first
acknowledged the execution of the instrument in the presence of,
as defined in W.S. 32-3-102(a)(iii), the notarial officer, if by
law the instrument is required to be recorded or filed and
cannot be filed without a certificate of acknowledgment signed
and sealed by a notarial officer.
