Text
Every person, upon the expiration of his term of office or
employment, shall deliver to his successor in office all
property in his possession belonging to the city or town, or
pertaining to the office held. Any person failing to do so
within five (5) days after being notified and requested by the
manager or president of the governing body, shall forfeit and
pay for the use of the city five hundred dollars ($500.00) and
all damages caused by his neglect or refusal to deliver. The
amount may be recovered in an action brought for that purpose,
and the city may by action in the nature of replevin, or
mandamus proceedings, enforce the delivery of such property.
