Text
When partition of more than one (1) tract is demanded, the
commissioners shall set off to each plaintiff or party in
interest his proper proportion in each of the several tracts
unless the several tracts are owned by the same proprietors in
the same proportion in each tract, in which case the whole share
of any proprietor in all the several tracts may be set off to
the proprietor according to the best discretion of the
commissioners.
