§ 35-11-508 — Recycling and processing requirements for commercial solid waste management facilities

(a)In recognition of the need to minimize unnecessary
uses of the land for solid waste management, to allow for an
effective ability for state oversight, regulation and inspection
of solid wastes intended to be managed in the state and to
conserve natural resources in accord with the policy and purpose
of this act, commercial solid waste management facilities shall
conform to the following operating practices:
(i)Solid wastes shall be screened by the facility
operator in a manner approved by the director to assure to the
maximum practical extent that wastes prohibited from disposal at
the facility are not managed or disposed of at the facility.
Management or disposal of any prohibited waste by a facility
shall be cause for the council to issue a cessation order
preventing continued recei
