§ 62-18-120 — Violations

(a) A person commits a Class C misdemeanor who: (1) Presents or attempts to file as that person's own the certificate of registration of another; (2) Gives forged or willfully false evidence of any kind to the board or any member of the board for the purpose of obtaining a certificate; (3) Falsely impersonates any other practitioner; or (4) Uses or attempts to use an expired or revoked certificate of registration. (b) Any person who practices or offers to practice land surveying in this state in violation of this part commits a Class C misdemeanor. Each day of violation constitutes a separate offense. (c) A person shall be construed to practice, or offer to practice, land surveying who, by verbal claim, sign, advertisement, letterhead, card or any other way, represents the person to be a land surveyor, with or without qualifying adjectives, or through the use of some other title implies that the person is a land surveyor. (d) The grand juries of the state are given inquisitorial power over all violations of this part, and the judges of the courts shall give inquisitorial power in their charges to the grand juries. (e) It is the duty of the members of the board to report any violations of this part to the proper authorities. (f) "Person," as used in this section, includes firms and corporations. (g) Prosecutions for any person who practices or offers to practice land surveying in this state in violation of this part shall be commenced within four (4) years next after the offense has been committed.
