Text

As used in this part, unless the context otherwise requires:

(1)"Association" means the Tennessee self-insurers' guaranty association;
(2)"Commissioner" means the commissioner of commerce and insurance;
(3)"Insolvent self-insurer" means any member self-insurer as to whom the commissioner:
(A)Determines has failed to pay workers' compensation benefits to its employees as required by law; and (B) Notifies the association regarding such failure;
(4)"Member self-insurer":
(A)Means:
(i)A person holding an active certificate of authority from the commissioner to self-insure its workers' compensation liabilities pursuant to § 50-6-405(a)(2) ; or (ii) A person holding an inactive certificate of authority from the commissioner to self-insure its workers' compensation liabilities pursuant to
