§ 27-44-18. Penalties.
(a) The director may, if he or she finds that any person or organization has violated
            any provision of this chapter, impose a penalty of not more than one thousand dollars
            ($1,000) for each violation, but if the director finds the violation to be willful,
            he or she may impose a penalty of not more than fifty thousand dollars ($50,000) for
            each violation. The penalties may be in addition to any other penalty provided by
            law.

            failed to file the rate, supplementary rate information, or su

(a) The director may, if he or she finds that any person or organization has violated any provision of this chapter, impose a penalty of not more than one thousand dollars ($1,000) for each violation, but if the director finds the violation to be willful, he or she may impose a penalty of not more than fifty thousand dollars ($50,000) for each violation. The penalties may be in addition to any other penalty provided by law.

(b) For the purposes of this section, any insurer using a rate for which the insurer has failed to file the rate, supplementary rate information, or supporting information, as required by this chapter or by any rules and regulations that the director may promulgate, has committed a separate violation for each day that failure continues.

(c) The director may suspend or revoke the license of any rating organization or insurer that fails to comply with an order of the director within the time limited by the order, or any extension of the order that the director may grant.

(d) The director may determine when a suspension of license shall become effective and it shall remain in effect for the period fixed by him or her, unless he or she modifies or rescinds the suspension, or until the order upon which the suspension is based is modified, rescinded, or reversed.

(e) No penalty shall be imposed and no license shall be suspended or revoked except upon a written order of the director, stating his or her findings, made after a hearing.
