§ 27-2.4-19. Fiduciary capacity of insurance producers — Misappropriation as theft.
That portion of all premiums or moneys that a licensed insurance producer collects from a policyholder and that is to be paid to an insurance company, its agents, or the insurance producer's employer because of the assumption of liability through the issuance of insurance contracts, or that the insurance producer collects from an insurance company or its agents and that is to be paid to a policyholder or claimant under any contract of insurance, shall be held by the insurance producer in a fiduciary capacity and shall not be misappropriated or converted to the insura
