A license to practice as a certified mental health assistant issued under this chapter authorizes the holder to practice as a certified mental health assistant as follows:

(A)The certified mental health assistant shall practice only under the supervision, control, and direction of a physician with whom the certified mental health assistant has entered into a supervision agreement under section4772.10of the Revised Code.

(B)The certified mental health assistant shall practice in accordance with the supervision agreement entered into with the physician who is responsible for supervising the certified mental health assistant.

(C)Subject to division (D) of this section, a certified mental health assistant licensed under this chapter may perform any of the following services authorized by

A license to practice as a certified mental health assistant issued under this chapter authorizes the holder to practice as a certified mental health assistant as follows:

(A) The certified mental health assistant shall practice only under the supervision, control, and direction of a physician with whom the certified mental health assistant has entered into a supervision agreement under section4772.10of the Revised Code.

(B) The certified mental health assistant shall practice in accordance with the supervision agreement entered into with the physician who is responsible for supervising the certified mental health assistant.

(C) Subject to division (D) of this section, a certified mental health assistant licensed under this chapter may perform any of the following services authorized by the supervising physician that are part of the supervising physician's normal course of practice and expertise:

(1) Ordering diagnostic, therapeutic, and other medical services as appropriate based on a patient's diagnosis that has been made in accordance with division (D) of this section;

(2) Ordering, prescribing, personally furnishing, and administering drugs and medical devices in accordance with sections4772.12to4772.15of the Revised Code;

(3) Ordering occupational therapy or referring a patient to an occupational therapist for occupational therapy, if related to a diagnosis that has been made in accordance with division (D) of this section;

(4) Referring a patient to emergency medical services for acute safety concerns, provided the certified mental health assistant consults with the assistant's supervising physician as soon as possible thereafter.

(D) A certified mental health assistant shall not do any of the following:

(1) Make an initial diagnosis;

(2) Treat a patient for any diagnosis or condition not found in the most recent edition of the diagnostic and statistical manual of mental disorders published by the American psychiatric association, or a similar publication if designated by the board;

(3) Engage in electroconvulsive therapy, transcranial magnetic stimulation, or any other intervention designated as invasive by the board's rules.
