§ 17-1720 Fire districts; preservation of fire districts, fire\nprotection districts and fire alarm districts.
1.In every such village\nany fire districts created or organized under the provisions of the\ncounty law, shall be merged in and consolidated with such village and\nshall become a part of such village for fire protection purposes and all\nbuildings, engines, fire apparatus, and other property belonging to such\nfire district shall be vested in such village and maintained and\nadministered by it as a part of the fire protection system thereof. All\nthe powers and duties of the commissioners of such fire district shall\nbe and are hereby devolved upon and transferred to the board of trustees\nof such village. § 17-1720 Fire districts; preservation of fire districts, fire\nprotection districts and fire alarm districts. 1. In every such village\nany fire districts created or organized under the provisions of the\ncounty law, shall be merged in and consolidated with such village and\nshall become a part of such village for fire protection purposes and all\nbuildings, engines, fire apparatus, and other property belonging to such\nfire district shall be vested in such village and maintained and\nadministered by it as a part of the fire protection system thereof. For the purpose of paying the principal and interest of\nany bonds of any such fire district which may be outstanding and unpaid\nat the date of the incorporation of any such village, the board of\ntrustees of such village shall levy, assess and collect upon all the\ntaxable property in such village, a tax sufficient to pay the interest\nthereof as the same accrues and sufficient also to provide for the\npayment of the principal of such bonds at maturity.\n 2. At any time after the date the report of incorporation is delivered\nto the secretary of state pursuant to section 2-232 of the village law,\nand prior to the first day of June following the first day of January\nnext succeeding the date of incorporation, the board of trustees of any\nvillage in which a majority of the electors has approved a proposition\nsubmitted to the voters in accordance with subdivision three of section\n17-1708 hereof, may adopt a local law providing that any fire district,\nfire protection district, fire alarm district or any district\nfunctioning pursuant to section one hundred eighty-six of the town law\nwhich is located wholly or partly within the boundaries of such village,\nshall continue to function in all respects whatsoever, and all officers\nand employees of such entity shall continue to hold their offices and\nexercise their powers and duties, as though such village were not\nincorporated.\n 3. In the event that the board of trustees adopts a local law pursuant\nto subdivision two of this section, then notwithstanding any provision\nof sections 2-252, 2-254, 2-256, 2-258, 17-1704, 17-1720 or 17-1726 of\nthe village law, any such fire district, fire protection district, fire\nalarm district or any district functioning pursuant to section one\nhundred eighty-six of the town law which is located wholly or partly\nwithin the boundaries of such village, shall continue to function, in\nall respects whatsoever, and all officers and employees of such entity\nshall continue to hold their offices and exercise their powers and\nduties, as though such village were not incorporated.\n
