§ 133. Penalties for other than common carriers. 1. Any corporation,\nother than a common carrier which shall violate this chapter, or shall\nfail to obey, observe and comply with every order made by the\ncommissioner under authority of this chapter so long as the same shall\nbe and remain in force, shall forfeit to the people of the state of New\nYork a sum not exceeding one thousand dollars for each offense; every\nsuch violation shall be a separate and distinct offense, and the penalty\nor forfeiture thereof shall be recovered in an action as provided in\nsection ninety.\n 2. Every person who, either individually or acting as an officer or\nagent of a corporation other than a common carrier, shall violate this\nchapter, or fail to obey, observe or comply with any order made by the\ncommissioner under this chapter so long as the same shall be or remain\nin force, or who shall procure, aid or abet any such corporation in its\nviolation of this chapter, or in its failure to obey, observe or comply\nwith any such order, shall be guilty of a misdemeanor.\n 3. In construing and enforcing the provisions of this chapter relating\nto forfeitures and penalties the act of any director, officer or other\nperson acting for or employed by any common carrier or corporation,\nacting within the scope of his official duties or employment, shall be\nin every case and be deemed to be the act of such common carrier or\ncorporation.\n
