§ 901. Definitions. As used or referred to in this title, unless a\ndifferent meaning clearly appears from the context:\n 1. "Cost", as applied to any project, includes the cost of\nconstruction, the cost of the acquisition of all property, including\nreal property and other property, both real, personal and mixed,\nimproved and unimproved, the cost of the demolishing, removing or\nrelocating any buildings or structures on lands so acquired, including\nthe cost of acquiring any lands to which such buildings or structures\nmay be moved or relocated, the cost of all machinery, apparatus and\nequipment, financing charges, interest prior to, during and after\nconstruction to the extent not paid or provided for from revenues or\nother sources, the cost of engineering and architectural surveys, plans\nand specifications, the cost of consultant and legal services, the cost\nof guarantee, bond insurance or other credit support devices and the\ncost of other expenses necessary or incidental to the construction of\nany such project and the financing of the construction thereof,\nincluding the amount authorized in the resolution of the authority\nproviding for the issuance of bonds to be paid into any reserve or other\nspecial funds from the proceeds of such bonds and the financing of the\nplacing of any project in operation, including reimbursement to any\nmunicipality, state agency, the state, the United States government, or\nany other person for expenditures that would be costs of the project\nhereunder had they been made directly by the authority.\n 7. "County" means the county of Suffolk, New York.\n 8. "County executive" means the county executive of the county.\n 9. "County legislature" means the county legislature of the county.\n 10. "Governing body" means the members of the authority constituting\nand acting as the governing body of the authority.\n 11. "Municipality" means any county, city, town, village, special or\nimprovement district located or operating within or partly within the\nservice area.\n 12. "Person" means any natural person, firm, partnership, limited\nliability company, association, joint venture or corporation, exclusive\nof a public corporation as defined pursuant to article two-A of the\ngeneral construction law.\n 13. "Project" means a regional wholesale market facility operated\nprimarily for perishable agricultural commodities and commercial fishing\nproducts, including the lands, building, fixtures, equipment and other\nappurtenances necessary or incidental thereto, constituting an\nintegrated market for the service area and which serves as a significant\nsource of supply of such commodities to such area.\n 14. "Real property" means lands, structures, franchises, rights and\ninterests in land, air space, waters, land underwater, riparian rights\nand air rights and any and all things and rights included within said\nterm and includes not only fees simple absolute, but also any and all\nlesser interests including, but not limited to, easements,\nrights-of-way, uses, leases, licenses and all other incorporeal\nhereditaments and every estate, interest or right, legal or equitable,\nincluding terms for years and liens thereon by way of judgments,\nmortgages or otherwise.\n 15. "Revenues" means all rates, fees, charges, payments and other\nincome and receipts derived from the operation of the properties of the\nauthority including, without limiting the generality of the foregoing,\ninvestment proceeds and proceeds of insurance, condemnation, and sale or\nother disposition of assets, together with all federal, state or\nmunicipal aid, if any.\n 16. "Service area" means the area comprising the entirety of the\ncounty of Suffolk.\n 17. "State" means the state of New York.\n 18. "State agency" means any state officer, public benefit\ncorporation, department, board, commission, bureau or division, or other\nagency or instrumentality of the state.\n
