§ 2657. Employees, civil service.
1.The appointment and promotion of\nall non-exempt/non-management confidential employees of the authority\nshall be made in accordance with the civil service law and the rules of\nthe Schenectady county civil service commission.\n 2. In accordance with the provisions of section seventy of the civil\nservice law, any officer or employee of a municipality, school district\nor special district in the service area, may, at the request of the\nauthority, be transferred to the authority and shall be eligible for\nsuch transfer and appointment, without further examination, to\napplicable offices, positions and employment under the authority. Any\nsuch officers or employees so transferred to the authority pursuant to\nthis section, who are members of or benefit under any existing pension\nor retirement fund or system, shall continue to have all rights,\nprivileges, obligations and status with respect to such fund or system\nas are now prescribed by law, but during the period of their employment\nby the authority, all contributions to such funds or systems to be paid\nby the employer on account of such officers or employees shall be paid\nby the authority.\n 3. A transferred employee shall remain in the same collective\nbargaining unit as was the case prior to his or her transfer. Successor\nemployees to the positions held by such transferred employees shall,\nconsistent with the provisions of article fourteen of the civil service\nlaw, be included in the same unit as their predecessors. Employees\nserving in positions in newly created titles shall be assigned to the\nsame collective bargaining unit as they would have been assigned to such\nunit were such titles created prior to the establishment of the\nauthority. Nothing contained in this title shall be construed (a) to\ndiminish the rights of employees pursuant to a collective bargaining\nagreement or (b) to affect existing law with respect to an application\nto the public employment relations board seeking a designation by the\nboard that certain persons are managerial or confidential.\n
