§ 2616. Appropriations by the state.
1.Notwithstanding the provisions\nof any general or special law, the director of the budget shall transfer\nto the authority from funds appropriated to the department of\nenvironmental conservation for the fiscal year beginning April first,\nnineteen hundred eighty-one, the amount necessary including an amount\nfor general state charges to provide for the operation of participating\nolympic facilities pursuant to agreements made with state agencies in\naccordance with section twenty-six hundred fourteen of this title.\n 2. § 2616. Appropriations by the state. 1. Notwithstanding the provisions\nof any general or special law, the director of the budget shall transfer\nto the authority from funds appropriated to the department of\nenvironmental conservation for the fiscal year beginning April first,\nnineteen hundred eighty-one, the amount necessary including an amount\nfor general state charges to provide for the operation of participating\nolympic facilities pursuant to agreements made with state agencies in\naccordance with section twenty-six hundred fourteen of this title.\n 2. On or before August fifteenth, nineteen hundred eighty-one, and on\neach August fifteenth thereafter the chair of the authority shall make\nand deliver to the director of the budget for his or her approval and\nfor submission to the legislature a budget for the operation of the\nauthority for the forthcoming fiscal year of the state. The chair of the\nauthority shall deliver a copy of such budget to the chair of the senate\nfinance committee and the chair of the assembly ways and means committee\nat the same time that the budget is delivered to the director of the\nbudget. The budget shall delineate the total amount needed for authority\npurposes, including the funds required by the authority for operation of\nthe olympic facilities, the Gore Mountain ski center and the Belleayre\nMountain ski center pursuant to agreements made in accordance with\nsections twenty-six hundred twelve and twenty-six hundred fourteen of\nthis title, the source of all funds that the authority expects to\nreceive and such other information as the director of the budget shall\nrequire. The director of the budget shall approve the budget for the\noperation of the authority and the governor shall recommend in his or\nher annual budget appropriations to the authority if the director of the\nbudget determines that the budget demonstrates that the authority,\nwithout operating at a deficit, can continue in the forthcoming fiscal\nyear of the state, in the exercise of its corporate purposes, powers,\nduties and functions with the appropriations from the state and park\ndistrict in the amounts determined in accordance with sections\ntwenty-six hundred twelve and twenty-six hundred fourteen of this title\nand income received by the authority from other sources. The director of\nthe budget shall notify the park district, the chair of the senate\nfinance committee and the chair of the assembly ways and means committee\nnot later than October first of each year whether or not he has approved\nthe budget.\n 3. The state may appropriate and provide to the authority an amount of\nmoney determined in accordance with paragraph (g) of subdivision two and\nwith subdivision three of section twenty-six hundred fourteen of this\ntitle.\n 4. To further assist the authority in carrying out its corporate\npurposes, the governor shall recommend to the legislature in his annual\nbudget appropriation of such funds as may be available for such purposes\nfrom the earnings and accumulated income upon the principal of the\nwinter sports education trust fund, pursuant to subdivision four of\nsection four hundred ninety-five-a of the education law.\n 5. Notwithstanding the provisions of any general or special law, no\npart of such appropriations shall be available for the purposes\ndesignated until a certificate of approval of availability shall have\nbeen issued by the director of the budget and a copy of such certificate\nis filed with the state comptroller, the chairman of the senate finance\ncommittee and the chairman of the assembly ways and means committee.\nSuch certificate may be amended from time to time, subject to the\napproval of the director of the budget, and a copy of each such\namendment shall be filed with the state comptroller, the chairman of the\nsenate finance committee and the chairman of the assembly ways and means\ncommittee.\n 6. Notwithstanding the provisions of section four hundred\nninety-five-a of the education law, the sum of seven hundred fifty\nthousand dollars ($750,000), is hereby appropriated to the authority\nfrom the accumulated earnings upon the principal of the winter sports\neducation trust fund.\n
