§ 2655 — General purposes and powers of the authority

§ 2655. General purposes and powers of the authority. The general\npurposes of the authority shall be to design, develop, plan, finance,\ncreate, site, construct, renovate, administer, operate, manage, and\nmaintain all metroplex facilities and metroplex parks within the service\ndistrict defined in section twenty-six hundred fifty-four of this title.\nTo carry out such purposes the authority shall have the power:\n 1. To sue and be sued;\n 2. To acquire, hold and dispose of real and personal property for its\ncorporate purposes;\n 3. To have a seal and alter the same at pleasure;\n 4. To borrow money and issue bonds for any of its corporate purposes\nor its projects, or to refund the same, and to provide for the rights of\nthe holders thereof;\n 5. To make, subject to the provisions of section twenty-six hundred\nfifty-five-a of this title, by-laws for the management and regulation of\nits affairs and, subject to agreements with bondholders, for the design,\ndevelopment, planning, construction, financing, operation, management,\nsiting and maintenance of all metroplex facilities and metroplex parks\nwithin the service district;\n 6. To appoint officers, agents and employees; and to describe their\nqualifications and fix their compensation; subject, however, to the\nprovisions of the civil service law as provided in this title;\n 7. To make contracts and leases, and to execute all instruments\nnecessary or convenient;\n 8. To design, develop, plan, finance, create, site, construct,\nrenovate, administer, operate, manage and/or maintain such buildings,\nparks, structures, and other facilities as may be necessary or\nconvenient, specifically, but not limited to:\n (a) trade exhibition facilities;\n (b) public show facilities;\n (c) public entertainment facilities and parks;\n (d) hotel and overnight accommodation facilities;\n (e) transportation and parking facilities;\n (f) historic preservation facilities and parks;\n (g) tourism facilities and parks;\n (h) sporting event facilities and parks;\n (i) special entertainment facilities and parks;\n (j) educational facilities and parks;\n (k) cultural and social facilities and parks;\n (l) infrastructure facilities;\n (m) industrial and manufacturing facilities and parks; and/or\n (n) business, commercial, retail, and/or government office space,\nbuildings and/or facilities;\n 9. To collect revenues, dues, costs, assessments, rentals, fees and\nother charges for the use of real or personal property and/or facilities\nand parks of the authority subject to and in accordance with such\nagreements with bondholders as may be provided in this title;\n 10. To contract for the services of architects, engineers,\nconsultants, lawyers, financial and other professional advisors,\ndevelopers, contractors, vendors, concessioners, tenants, facility\nand/or park users, occupants and managers and other professional\nconsultants and service providers, and to fix their compensation;\n 11. To declare, designate, establish, design, create, site, construct,\ndevelop, plan, finance, operate, renovate, administer, manage and/or\nmaintain parks and park districts within the service district so as to\nestablish parks and/or park districts for historic preservation,\neducational entertainment, and/or recreation;\n 12. Upon the resolution of a municipality, to avoid, and be exempt\nfrom, zoning and/or planning requirements, laws and/or regulations\nestablished, created or enacted by the municipality;\n 13. To designate the depositories of its money;\n 14. To establish its fiscal year;\n 15. To appoint such officers, employees and agents as the authority\nmay require for the performance of its duties and to fix and determine\ntheir qualifications, duties, and compensation subject to the provisions\nof the civil service law and any applicable collective bargaining\nagreement, and to retain or employ counsel, auditors, engineers and\nprivate consultants on a contract basis or otherwise for rendering\nprofessional, management or technical services and advice;\n 16. To receive and consider reports and recommendations from any\nadvisory councils or boards as may be established by local law,\nordinance, or resolution; and\n 17. To do all things necessary, convenient or desirable, including\nancillary and incidental activities, to carry out its purposes and for\nthe exercise of the powers granted in this title.\n
