§ 2654. Schenectady metroplex service district.
1.The Schenectady\nmetroplex service district shall include all real property within the\ncounty of Schenectady, from the Albany county/Schenectady county border\nto the Montgomery county/Schenectady county border, and within\nthirty-five hundred feet of Route 5, except from the intersection of\nRoute 5/State Street and Brandywine Avenue to the intersection of Route\n5/Mohawk Avenue and Route 147/Sacandaga Road, whereupon the Schenectady\nmetroplex service district shall include all real property within\neighty-seven hundred fifty feet of Route 5. § 2654. Schenectady metroplex service district. 1. The Schenectady\nmetroplex service district shall include all real property within the\ncounty of Schenectady, from the Albany county/Schenectady county border\nto the Montgomery county/Schenectady county border, and within\nthirty-five hundred feet of Route 5, except from the intersection of\nRoute 5/State Street and Brandywine Avenue to the intersection of Route\n5/Mohawk Avenue and Route 147/Sacandaga Road, whereupon the Schenectady\nmetroplex service district shall include all real property within\neighty-seven hundred fifty feet of Route 5. The service district shall\nalso include all real property within Schenectady county from the town\nof Rotterdam/city of Schenectady border to the Schoharie\ncounty/Schenectady county border and within the boundaries and\naccompanying right of way of state Route 7; and all real property within\ntwo hundred feet of Chrisler Avenue in the city of Schenectady except as\nexcluded by subdivision two of this section.\n 2. Notwithstanding any other provision of law, unless amended pursuant\nto local law, the Schenectady metroplex service district shall not\ninclude any parcel of real property upon which a non-multiple dwelling\nresidence is located in the city of Schenectady and within the\nboundaries of the historic GE realty plot district, the Union College\nTriangle, the Mont Pleasant neighborhood association, or any defined\nneighborhood within the Schenectady united neighborhood associations.\n 3. The Stockade Historic District shall be included within the\nSchenectady Metroplex Service District for the purposes of the design,\ndevelopment, planning, financing, creation, siting, construction,\nrenovation, administration, operation, management, and/or maintenance of\nfacilities, structures or parks as defined in paragraphs (e), (f), (g),\n(h), (i), (j), (k) and (l) of subdivision eight of section twenty-six\nhundred fifty-five of this title.\n 4. Any municipality located within the county shall have the power to\nincrease the boundaries of the Schenectady metroplex service district\nwithin the municipality. To increase the boundaries of the service\ndistrict within a municipality, the municipality must conduct a public\nhearing and enact by a two-thirds vote a local law defining the\nadditional boundaries of such district. In the event a municipality\nelects to increase the boundaries of the service district, two certified\ncopies of the local law increasing the service district, together with\ntwo certified maps designating such increased boundaries shall be filed\nwith the office of the chairman of the Schenectady metroplex development\nauthority. Within ten days of the filing of such certified copies and\nmaps with the office of the chairman of the Schenectady metroplex\ndevelopment authority, such chairman shall file one certified copy of\nsuch local law and one certified copy of such map with the commissioner\nof the New York state department of taxation and finance. The territory\nand boundaries of the Schenectady metroplex development service district\nshall not be required to be contiguous.\n
