(a) The office shall create the New York state two hundred fiftieth\ncommemoration commission. From the effective date of this section until\nDecember thirty-first, two thousand thirty-three, such commission shall\ndevelop plans to promote and coordinate activities to commemorate the\ntwo hundred fiftieth anniversary of the American Revolution. Such plans\nmay include:\n (i) including heritage organizations as the focal points for the\ncommemoration;\n (ii) coordinating forums across the state to seek ideas from the\npublic on the commemoration including how New Yorkers, Americans and\nthose from other countries may celebrate such anniversary;\n (iii) coordinating activities with civic, educational and heritage\norganizations to develop public interest and involvement in the planning\nand development of the commemoration;\n (iv) promoting and encouraging educational outreach programs using\nmedia and technology including electronic communications to achieve\nnational and international impact;\n (v) coordinating the planning of commemorative events for all\ninterested communities throughout the state;\n (vi) inviting other interested states and nations to participate in\nprograms and events for the commemoration;\n (vii) coordinating and promoting the holding of meetings, conferences,\nseminars and conventions in interested communities using such\nanniversary as an attraction and theme;\n (viii) coordinating and promoting the holding of community engagement\nand educational events in interested communities using such anniversary\nas an attraction and theme;\n (ix) seeking funding from private individuals, foundations and\ncorporations to support capital improvements, preservation and\nconservation needs associated with events and sites commemorating such\nanniversary;\n (x) coordinating and cooperating with state entities and tourist\npromotion agencies, as defined in article five-A of the economic\ndevelopment law;\n (xi) coordinating and cooperating with local, state and federal\nentities including those relating to heritage area promotion and any\nfederal commission created to participate in planning and development of\nsuch anniversary observance; and\n (xii) setting goals and benchmarks for the work of the commission.\n (b) The commission may coordinate and consult with the New York state\nmilitary museum and veterans research center, Saratoga national\nhistorical park, Champlain Valley National Heritage Partnership, Erie\nCanalway National Heritage Corridor, Maurice D. Hinchey Hudson River\nValley National Heritage Area, Niagara Falls National Heritage Area,\nHumanities New York, Association of Public Historian of New York State,\nthe Preservation League of New York State, national historic landmarks,\nnational historic landmark stewardship organizations and any other\norganizations it deems necessary in the development, planning, promotion\nand coordination of activities to commemorate the two hundred fiftieth\nanniversary of the American Revolution.\n (c) The commission may coordinate and consult with each of the\nfollowing: the Cayuga Nation, the Oneida Indian Nation, the Onondaga\nIndian Nation, the Saint Regis Mohawk Tribe, the Seneca Nation of\nIndians, the Shinnecock Indian Nation, the Stockbridge-Munsee Community\nBand of Mohican Indians, the Tonawanda Band of Seneca, and the Tuscarora\nNation.\n (d) The commission shall consist of twenty-one voting members to be\nappointed as follows:\n (i) the commissioner or his or her designee;\n (ii) the commissioner of the department of education or his or her\ndesignee;\n (iii) the president and chief executive officer of empire state\ndevelopment or his or her designee;\n (iv) the commissioner of the office of general services;\n (v) the secretary of state or his or her designee;\n (vi) chair of the New York state tourism advisory council or his or\nher designee;\n (vii) chair of the council for the arts or his or her designee;\n (viii) director of the canal corporation or his or her designee;\n (ix) four members shall be appointed by the governor, three members\nshall be appointed by the temporary president of the senate, three\nmembers shall be appointed by the speaker of the assembly, one member\nshall be appointed by the minority leader of the senate and one member\nshall be appointed by the minority leader of the assembly, to the extent\npracticable, these appointments shall include a representative from each\nof the ten regional economic development councils; and\n (x) the New York state historian.\n (d) To the extent practicable, such appointees shall have a\nprofessional background in one or more of the following fields: local\ngovernment historian, academic historian, museum professional, social\nstudies teacher or professor, tourism professional, archeologist,\nanthropologist, or other expertise in the field of New York state\nhistory and/or historic preservation, or professional or volunteer\nfundraising experience.\n (e) The commissioner and the commissioner of the department of\neducation shall be co-chairpersons of the commission. Vacancies in the\nmembership of the commission shall be filled in the same manner provided\nfor original appointments.\n (f) A majority of the members of the commission shall constitute a\nquorum.\n (g) The members of the commission shall receive no compensation for\ntheir services but shall be allowed their actual and necessary expenses\nincurred in the performance of their duties.\n (h) The commission shall hold a meeting at least once each quarter.\n 3. The commission shall have the power:\n (a) to prepare, publish and disseminate information or reports to\nhighlight for state agencies, local governments, and the general public\nissues, problems, and opportunities relevant to the two hundred fiftieth\nanniversary of the American Revolution;\n (b) to assist local governments and other appropriate organizations to\nplan commemorations of the two hundred fiftieth anniversary of the\nAmerican Revolution, and to do this, as far as possible, through\ncooperation and through technical assistance, including planning\nassistance, citizen education and participation assistance, and\nassistance in preparation of grant applications to other entities;\n (c) to apply for and receive funds from the federal and state\ngovernment;\n (d) notwithstanding any inconsistent provision of law, to solicit and\naccept gifts for the purpose of furthering the objectives of the\ncommission pursuant to this section;\n (e) to conduct historical, economic and cultural studies;\n (f) to conduct education programs;\n (g) to assist individuals, corporations, heritage organizations and\nother public entities on ways to protect and promote the heritage\nresources of the state;\n (h) to prepare an annual report on the conduct of its activities which\nshall be delivered to the governor, temporary president of the senate,\nand the speaker of the assembly by January first;\n (i) to serve a coordinating role in utilizing the capabilities of\nother organizations to carry out the duties prescribed in this section;\nand\n (j) to exercise and perform such other powers and duties as shall have\nbeen or may be conferred by law.\n 4. (a) The commission shall develop a strategic plan, which shall\nrecommend plans for commemorating the state's role in the founding of\nthe nation and the ensuing two hundred fifty years of history.\n (b) The strategic plan shall be consistent with existing management\nplans for resources included in the plan.\n (c) Such strategic plan may include, but shall not be limited to, a\nsurvey or inventory of the following, together with the establishment of\nmanagement priorities thereof: (i) historic, cultural and other heritage\nresources; (ii) scenic resources; and (iii) educational and recreational\nresources.\n (d) By December thirty-first, two thousand twenty-two, the commission\nshall vote to finalize the recommendation contained in the strategic\nplan. A copy of the strategic plan shall be provided to the governor,\nthe temporary president of the senate and the speaker of the assembly.\n (e) The commission may propose amendments to the strategic plan\ndescribed in this subdivision as they are deemed to be necessary and\nappropriate.\n 5. To effectuate the purposes of this section, the commission may\nrequest from any department, board, bureau, commission or other agency\nof the state, and the same are authorized to provide, such cooperation\nand assistance, services and data as will enable the commission to\nproperly carry out its functions pursuant to this section.\n 6. In administering the provisions of this section, the commission may\nmake, within the limitations of appropriations available thereof, grants\nto heritage organizations towards the costs of a project recommended in\nthe plan. The commission may submit letters of support for grant\napplications submitted by an organization for projects or programs\nrecommended in the plan.\n * NB Repealed December 31, 2033\n
