Notwithstanding the provisions of any general,\nspecial or local law, charter or administrative code to the contrary,\nand in lieu of any lesser amount otherwise prescribed, any person who is\nan officer or member of the uniformed force of the police department of\na city, and is a member of a police pension or retirement system\nmaintained by such city, and who has completed service as a member of\nsuch city-maintained police pension or retirement system for the minimum\nnumber of years specified in such plan or option selected by him as a\nnecessary prerequisite for a pension or retirement allowance on account\nof retirement for service shall, upon retirement for service, receive a\npension or retirement allowance on account of such minimum service which\nshall, subject to the provisions of this section, be equal to one-half\nof his annual compensation earnable upon the date of his retirement, or,\nin the event that such member shall have served as a member of the\ndetective division, or on special assignment, for a period of at least\nfive years during such service, provided, however, that such member\nshall have continued his pension contributions on the basis of his\nhighest annual compensation, one-half the maximum annual compensation\nearned by him while an officer or member of the uniformed force of the\npolice department of such city, whichever is greater.\n 2. Where a city-maintained pension plan or retirement system for\nofficers or members of the uniformed force of the police department,\nhousing police force or transit police force of such city provides, upon\nretirement for service, for a retirement allowance consisting of a\npension plus an annuity which is the actuarial equivalent of the\nmember's accumulated contributions at the time of his retirement, then\nin that event there shall be added by the city, whenever required, a\nfurther pension of such amount which together with the member's annuity\nshall be sufficient to provide him with a retirement allowance equal to\none-half of his annual compensation earnable on the date of his\nretirement, or, in the event that such member shall have served as a\nmember of the detective division, or on special assignment, for a period\nof a least five years during such service, provided, however, that such\nmember shall have continued his pension contributions on the basis of\nhis highest annual compensation, one-half the maximum annual\ncompensation earned by him while an officer or member of the uniformed\nforce of the police department, housing police force or transit police\nforce of such city, whichever is greater. For the purpose only of\ndetermining the amount of the additional pension contribution by the\ncity that may be required, the member's annuity, if any, shall be\ncomputed as it would be, (a) if it were not reduced by the actuarial\nequivalent of any outstanding loan, (b) if it were not increased by the\nactuarial equivalent of any additional contributions, (c) if it were not\nreduced by reason of the member's election to decrease his annuity\ncontributions in order to apply the amount of such reduction in payment\nof his contributions for old-age and survivors insurance coverage, (d)\nas it would be without any optional modification.\n 3. Where a city-maintained pension plan or retirement system for\nofficers or members of the uniformed force of the police department of\nsuch city provides for disability retirement, such retirement allowance\nshall be computed on the basis of the annual compensation earnable on\nthe date of the retirement for disability of any member.\n 4. Where additional retirement benefits are payable under the\ncity-maintained pension plan or retirement system, or are required to be\npaid pursuant to section two hundred seven-d of this chapter, such\nadditional benefits shall be paid, for service in addition to and in\nexcess of the minimum service requirements, in addition to the minimum\nretirement benefits required to be paid by this section.\n 5.
