§ 169. Salaries of certain state officers.
1.Salaries of certain\nstate officers holding the positions indicated hereinbelow shall be as\nset forth in subdivision two of this section:\n (a) commissioner of corrections and community supervision,\ncommissioner of education, commissioner of health, commissioner of\nmental health, commissioner of developmental disabilities, commissioner\nof children and family services, commissioner of temporary and\ndisability assistance, chancellor of the state university of New York,\ncommissioner of transportation, commissioner of environmental\nconservation, superintendent of state police, commissioner of general\nservices, commissioner of the division of homeland security and\nemergency services and the executive director of the state gaming\ncommiss

Salaries of certain\nstate officers holding the positions indicated hereinbelow shall be as\nset forth in subdivision two of this section:\n (a) commissioner of corrections and community supervision,\ncommissioner of education, commissioner of health, commissioner of\nmental health, commissioner of developmental disabilities, commissioner\nof children and family services, commissioner of temporary and\ndisability assistance, chancellor of the state university of New York,\ncommissioner of transportation, commissioner of environmental\nconservation, superintendent of state police, commissioner of general\nservices, commissioner of the division of homeland security and\nemergency services and the executive director of the state gaming\ncommission;\n (b) commissioner of labor, chairman of public service commission,\ncommissioner of taxation and finance, superintendent of financial\nservices, commissioner of criminal justice services, and commissioner of\nparks, recreation and historic preservation;\n (c) commissioner of agriculture and markets, commissioner of addiction\nservices and supports, adjutant general, commissioner and president of\nstate civil service commission, commissioner of economic development,\npresident of higher education services corporation, commissioner of\nmotor vehicles, member-chair of board of parole, chair of public\nemployment relations board, secretary of state, executive director of\nthe housing finance agency, commissioner of housing and community\nrenewal, executive director of state insurance fund, commissioner-chair\nof state liquor authority, chair of the workers' compensation board;\n (d) director of office for the aging, commissioner of human rights,\ncommissioners of the department of public service, chairman of state\ncommission on quality of care for the mentally disabled, chairman of\ncommission on alcoholism and substance abuse prevention and education,\nexecutive director of the council on the arts and executive director of\nthe board of social welfare;\n (e) chairperson of state athletic commission, director of the office\nof victim services, chairperson of human rights appeal board,\nchairperson of the industrial board of appeals, chairperson of the state\ncommission of correction, members of the board of parole,\nmember-chairperson of unemployment insurance appeal board, director of\nveterans' services, and vice-chairperson of the workers' compensation\nboard;\n (f) executive director of adirondack park agency, members of state\ncommission of correction, members of unemployment insurance appeal\nboard, and members of the workers' compensation board.\n 2. (a) Effective January first, nineteen hundred ninety-nine, the\nannual salaries of the officers holding the positions indicated in\nsubdivision one of this section shall be as follows: for the positions\nlisted in paragraph (a), $136,000; in paragraph (b), $127,000; in\nparagraph (c), $120,800; in paragraph (d), $109,800; in paragraph (e),\n$101,600; and in paragraph (f), $90,800.\n (b) Notwithstanding any of the foregoing provisions of this section to\nthe contrary, an incumbent in a position (i) listed in former section\none hundred sixty-nine of the executive law in effect on the day prior\nto the effective date of this subdivision, or (ii) listed in this\nsection, or (iii) covered by a provision of law other than such section,\nshall not receive compensation in an amount less than such person\nreceived on the effective date of this section.\n 3. Notwithstanding any other provision of this section or any other\nprovision of law, the boards of trustees of the state university of New\nYork and the city university of New York shall each establish and\nimplement salary plans for the chancellors, presidents and senior staffs\nof such state and city universities, respectively. The board of regents\nshall establish and implement a separate salary plan for the president\nof the university of the state of New York, setting forth the\ncompensation to be received by the president for performing the duties\nof that office assigned by the rules of the regents or statute, which\nshall be in addition to the compensation received by such person\npursuant to the provisions of subdivisions one and two of this section.\nSuch salary plans shall be developed after consultation with the\ngovernor's office of employee relations and the division of the budget.\nAny increase in compensation for the positions set forth in this\nsubdivision, not otherwise funded from any appropriation, shall be\nfunded from reallocations of funds within the appropriations\nspecifically identified by the aforementioned boards. Each board of\ntrustees and the board of regents shall file a proposed salary plan\nreport with the chairs of the senate finance committee and the assembly\nways and means committee and the director of the budget at least sixty\ndays prior to the effective date of such salary plan. Each salary plan\nreport shall set forth the salary schedule, the dollar value of\nadditional public compensation and other employment benefits that such\npositions would receive, the specific sources of funding to be\nreallocated for salary increases, the amount of increase to be provided\nto each position, the comparison salary data on which the plan is based,\nand such other information as the boards of trustees and the board of\nregents deem appropriate.\n
