§ 28-0105. Definitions.\n As used in this article, the following words and phrases shall mean:\n 1. "Hazardous substance" shall mean any substance listed as a\nsubstance hazardous to public health, safety or the environment in\nregulations promulgated pursuant to article 37 of this chapter.\n 2. "Local agency" shall mean any local agency, board, district,\ncommission or governing body, including any city, county, or other\npolitical subdivision of the state.\n 3. "Pollution prevention" shall mean changes in production methods,\nwork practices, raw materials or the provision of services that reduce\nenergy or resource consumption, or that reduce, avoid or eliminate the\nuse of hazardous substances or the generation of such substances,\npollutants or waste per unit of product or service provided, so as to\nreduce risks to public health or the environment, without shifting risks\nbetween individuals or environmental media. Such term shall include the\nredesign, modification, upgrade or replacement of processes, procedures,\nequipment or technology; reformulation or redesign of products,\nsubstitution of inputs or raw materials; improvements in housekeeping,\nmaintenance, training or inventory control; and extended use or reuse of\nmaterials through methods integral to the production process or\nprovision of service, such as in-process, closed-loop recycling. Such\nterm shall not include incineration, energy recovery from the combustion\nof waste, transfer from one medium of release or discharge to another\nmedium, off-site or out-of-production recycling, end-of-pipe treatment,\nor any practice which alters the physical, chemical or biological\ncharacteristics or volume of a hazardous substance, pollutant or solid\nwaste through a process or activity which itself is not integral to and\nnecessary for the production of a product or the providing of a service.\n 4. "Pollutant" shall mean any substance, contaminant, waste or\nemission which contributes to pollution.\n 5. "Solid waste" shall mean a solid waste as such term is defined by\nsubdivision 1 of section 27-0701 of this chapter.\n 6. "State agency" shall mean any state department, agency, board,\npublic benefit corporation, public authority or commission.\n
