The state energy conservation construction code provided\nfor in this article, or any portion thereof, any modification of or\namendments thereto.\n 6. "Commercial building." Any building that is not a residential\nbuilding.\n 7. "Conditioned space." An area or room which is within a building and\nwhich is (a) being heated or cooled, (b) contains uninsulated ducts, or\n(c) has a fixed opening directly into an adjacent conditioned space.\n 8. "Equipment." Plumbing, heating, electrical, lighting, insulating,\nventilating, air conditioning, and refrigerating equipment, elevators,\nescalators, and other mechanical additions or installations but does not\ninclude any items constituting an industrial or commercial process.\n 9. "Historic building." Any building that is one or more of the\nfollowing: (a) listed, or certified as eligible for listing, on the\nnational register of historic places or on the state register of\nhistoric places, (b) designated as historic under an applicable state or\nlocal law, or (c) certified as a contributing resource within a national\nregister-listed, state register-listed, or locally designated historic\ndistrict.\n 10. "IECC" or "International Energy Conservation Code." The\nInternational Energy Conservation Code, published by International Code\nCouncil, Inc.\n 11. "Life-cycle cost." An estimate of the total cost of acquisition,\noperation, maintenance, and construction of any energy system within or\nrelated to a building over the design life of the building. "Life-cycle\ncost" includes, but is not limited to, the cost of fuel, materials,\nmachinery, ancillary devices, labor, service, replacement, and repairs.\n 12. "Local government." Any village, town (outside the area of any\nincorporated village) or city.\n 13. "Municipality." Any county, city, town, village, school district\nor district corporation.\n 14. "Owner." The owner or owners of the freehold of a premises or any\nlesser estate therein, a mortgagee or vendee in possession, a contract\nvendee, assignee of rents, receiver, executor, trustee, lessee, or any\nother person, firm or corporation in control of a building.\n 15. "Residential building." Any building which is designed or is to be\nused primarily as a dwelling or household as defined by the state fire\nprevention and building code council, including any factory manufactured\nhome as defined in subdivision eight of section three hundred\nseventy-two of the executive law and any mobile home as defined in\nsubdivision thirteen of section three hundred seventy-two of the\nexecutive law.\n 16. "Uniform code." The New York state uniform fire prevention and\nbuilding code adopted, and as may be amended, pursuant to article\neighteen of the executive law.\n
