4. As used in this act: "Commissioner" means the Commissioner of Human Services. "Department" means the Department of Human Services. "Medicaid" means the New Jersey Medical Assistance and Health Services Program established pursuant to P.L.1968, c.413 (C.30:4D-1 et seq.). "NJ FamilyCare" or "program" means the NJ FamilyCare Program established pursuant to sections 3 through 5 of P.L.2005, c.156 (C.30:4J-10 through C.30:4J-12). "Poverty level" means the official federal poverty level based on family size, established and adjusted under Section 673(2) of Subtitle B, the "Community Services Block Grant Act," Pub.L.97-35 (42 U.S.C. s.9902(2)). "Qualified applicant" means: a. a child under 19 years of age:

(1)whose family gross income does not exceed 350% of the poverty level;
(2)who has no
