No disposal plant or dead animal substation shall be located or constructed at any place in this state inside of, or within two miles of the nearest point of the corporate limits of, any city or town; nor within one mile of the nearest boundary of the lands then owned or controlled in connection either with any state, county, township, city, or town park; or of any public school or hospital; or of any charitable, religious or educational institution; provided, however, that where a disposal plant for dead bodies is now operating that does not comply with the provisions of this section as to location, such disposal plant may continue operation in its present location, provided the plant meets all the provisions and regulations of this chapter as to sanitation, and is not a public nuisance o
