§1710. Leases for encroachments wholly upon public lands; leases for encroachments under this Title
A.Where an encroachment is located wholly upon state waterbottoms
and not proximate to any bank or shore, a lease may be granted under the
procedure, terms and conditions for the leasing of public lands contained in
R.S. 41:1213 through 1217, except that any lease of encroachments under this
Section shall be limited to an area reasonably required to operate or maintain
the encroachment as described in the permit for its construction.
B.Structures and encroachments which are the subject matter of
Subsection B of Section 91, Sections 1262 through 1269, and Sections 1501
through 1509 of Title 41 of the Louisiana Revised Statutes of 1950 are exempt
from obtaining leases under this Chapter.
