§ 36-9-29-4 — Petition to establish district; procedure

(a) Upon the adoption of a declaratory
resolution under section 3 of this chapter, the city works board shall file
with the circuit court for the county in which the city is located a
petition requesting the establishment of a flood control district to
include the territory described in the resolution. A copy of the
resolution shall be attached to the petition. The petition shall be
docketed in the court as a pending cause, and shall be entitled "In the
matter of the city of ____________, petition for the establishment of
flood control district".
(b) Upon the filing of the petition, the circuit court shall fix a time
when the petition shall be heard, which may not be less than fifteen
(15) nor more than thirty (30) days after the filing. The clerk of the
court shall publish a notice of the hearing in accordance with IC 5-3-1.
The notice must:
(1) contain a brief summary of the petition;
(2) set out the description of the boundaries of the proposed
district, as set out in the resolution attached to the petition;
(3) state the time and place fixed for the hearing on the petition;
and
(4) advise all interested parties that they may appear and be heard.
(c) The clerk of the circuit court shall certify and send to the
attorney general, by registered mail, a copy of the petition, together
with a copy of the resolution attached to the petition and a copy of the
notice of hearing.
(d) After the publication and mailing of the notice, all persons
having any interest in property or highways located in the petitioning
city, or within four (4) miles outside the corporate boundaries of the
city, are conclusively presumed to have notice of the pendency of the
petition and all subsequent proceedings had under the petition.
