§ 36-7-4-1207 — Township joinder; joinder with county or municipality in other county

ADVISORY. If a township located in
another county is contiguous to:
(1) a municipal or county boundary;
(2) an area over which a municipality is exercising planning and
zoning authority; or
(3) a township that has joined a municipality or county under the
1200 series of this chapter;
and joinder is not precluded by section 1202 of this chapter, then it may
join either a contiguous municipality or a contiguous county that:
(A) has an advisory plan commission; and
(B) has adopted ordinances of the type specified in section 1202
of this chapter.
The procedures for joinder are the same as specified by sections 1203
and 1204 of this chapter, except that if joinder is with a county, the
petition must go to the county plan commission or the metropolitan
plan commission and the resolution of approval must be adopted by the
county legislative body.
